Permits, Application Forms, & Checklists
There are many different types of permits that are issued consistent with the provisions of N.J.A.C. 7:14A. NJPDES permits regulate/authorize the direct discharge of pollutants to surface and ground waters of the State, as well as the indirect discharge of pollutants to domestic treatment works (DTWs). In addition, some NJPDES permits regulate the generation, use and disposal of residuals. Treatment Works Approval (TWA) permits regulate/authorize the construction and operation of industrial and domestic wastewater collection, conveyance and treatment facilities, including treatment plants, pumping stations, interceptors, sewer mains and other collection holding and conveyance systems.

NJPDES Discharge to Surface Water (DSW) Permits
DSW General Permits
Consolidated Potable Water Treatment Plant General Permit (Category BPW)

Description
This general permit authorizes the discharge of wastewater associated with potable water treatment which is largely comprised of filter backwash. Potable water treatment plants provide potable water, after appropriate treatment, for domestic and industrial use.

Consolidated School General Permit (Category ASC)

Description
This general permit authorizes the discharge of treated and disinfected domestic wastewater from school facility treatment plants to eligible surface waters of the State. School facilities contained under this general permit are small quantity dischargers, seasonal dischargers, and no off-site contribution.

General Remediation Clean Up Discharge General Permit (Category BGR)

Description
This general permit authorizes the discharge of treated groundwater resulting from groundwater remediations, dewaterings and pump test activities that do not typically contain petroleum products to eligible surface waters of the state. This general permit does not authorize a discharge into waters classified as FW-1, Category One and Pinelands.

Ground Water Petroleum Product Clean Up General Permit (Category B4B)

Description
This general permit authorizes the discharge of treated groundwater from remediations, dewaterings, and pump test activities that may be necessary due to contamination by petroleum products (i.e., fuel oil, diesel fuel, kerosene, aviation fuel, and gasoline) to eligible surface waters of the State. This permit is not intended for groundwater contamination at residential homes.

Harmful Algal Bloom Management General Permit (Category HAB)

Description
This new general permit authorizes the application of certain chemical and biological products to lakes and ponds, classified as Category 2 (C2) designated receiving waters. As coordinated with the Department’s Division of Science and Research, this general permit is limited to the products specified in the Product Sheets of Appendix B. Applicants requesting authorization for this general permit must possess a valid Commercial Pesticide License and be certified in Category 5 – Aquatic Pest Control.

Hydrostatic Test Water Discharge General Permit (Category BG)

Description
This general permit authorizes the discharge from planned hydrostatic testing of storage tanks and pipelines that have been cleaned pursuant to recognized federal, state or general industry documented procedures to eligible surface waters of the state. This general permit does not authorize a discharge to waters classified as FW1, Category One and Pinelands is not permitted. In addition, this general permit does not authorize the discharge from activities associated with the cleaning water or tank bottom water.
Applicants must request authorization to be covered under this general permit by submitting a completed and signed application electronically to hydrostatictestgp@njdepwptest.net at least fourteen (14) calendar days prior to the anticipated discharge.

Non-Contact Cooling Water Discharge General Permit (Category CG)

Description
This general permit authorizes the discharge of non-contact cooling water, non-contact cooling water commingled with stormwater, cooling tower blowdown, boiler water discharge (i.e., boiler blowdown and boiler bleed-off), and/or air conditioning condensate water to eligible surface waters of the state. Non-contact cooling water is used to cool down various types of industrial and manufacturing equipment without directly coming into contact with facility processes. This general permit does not authorize the discharge into those waters classified as FW1, Category One, Pinelands and certain Shellfish waters.

Pesticide Application Discharge General Permit (Category PGP)

Description
This general permit authorizes the applications of biological and chemical pesticides in water when such applications are made in, over, or near surface waters of the State. A request for authorization under this permit is required for certain entities and for applications over certain annual treatment thresholds as defined in Table 1 (found below).
This NJPDES general permit is issued to ensure compliance with the Clean Water Act and does not supersede and/or replace any permits issued by NJDEP’s Pesticide Control Program. This NJPDES permit also does not negate the requirements under any other federal, state, and local laws and regulations including, but not limited to Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), Pinelands Commission Certificate of Filing, Aquatic Pesticide Permit, Mosquito/Fly Control Permit, and Reporting to the National Response Center.

Short Term De Minimis Discharge General Permit (Category B7)

Description
This general permit authorizes the discharge of short term, uncontaminated groundwater generated during construction activities for the purpose of lowering the groundwater table to eligible surface waters of the State. A de minimis discharge for the purposes of this general permit is defined as a discharge containing a relatively insignificant amount of pollutants that complies with all of the conditions specified in this permit, including the requirements specified in Attachment 1 in the Request For Authorization (RFA) Certification Form below. This general permit does not authorize the discharge into those waters classified as FW1 and certain Shellfish waters.
Applicants must request authorization to be covered under this general permit by submitting a completed and signed Request For Authorization (RFA) Certification Form, including the associated unfiltered and untreated effluent analytical data. Application forms must be received by the Department at least 14 days prior to discharge via email at deminimisgp@njdepwptest.net.

Swimming Pool Discharge General Permit (Category B6)

Description
This general permit authorizes the discharge from the draining of pool water and/or filter backwash from any municipal, commercial, non-residential or community (e.g., townhouses and condominiums) swimming pools to eligible surface waters of the State. This general permit is not intended for swimming pool discharges from residential homes.
This general permit does not authorize the discharge into those waters classified as FW1, Pinelands and certain Shellfish waters. In addition, the discharge of filter backwash water to a Category One designated receiving waters is not permitted.

This individual NJPDES DSW permit is issued to those facilities that discharge treated and non-treated wastewater derived from, but not limited to process and non-process wastewater, contact and non-contact cooling water and comingled storm water run-off.

Basin Discharges at Sanitary Landfills (Category I1)

Description
This general permit authorizes stormwater basin discharges to ground water at operating sanitary landfills. The permit is for site runoff into sedimentation basins, retention basins, detention basins, and surface impoundments (collectively referred to as basins). This runoff (rainwater) flows into basins without contacting landfill refuse. The permit includes monitoring among other permit requirements.

Dental Amalgam General Permit (Category K2)

Description
This general permit authorizes those who discharge wastewater to the ground water from new or existing dental facilities using individual subsurface sewage disposal systems, i.e. “septic systems”, or Class V Underground Injection Control (UIC) wells. This permit was developed to remove dental amalgam prior to entering the waste stream by requiring dental facilities that generate amalgam waste to implement Best Management Practices (BMPs) and install an amalgam separator.

Lined Surface Impoundments (Category LSI)

Description
This general permit authorizes the discharge of wastewater to lined surface impoundments. The Lined Surface Impoundment General Permit was developed to encourage the elimination of ground water discharges from unlined surface impoundments, basins or infiltration/percolation lagoons, and simplifies the regulatory requirements for permittees by not requiring discharge or ground water monitoring.

Potable Water Treatment Plants (Category I2)

Description
This general permit covers potable water treatment plants (WTP) discharging filter backwash and clarifier water to outdoor basins. The discharge results from the process of bringing raw water supplies to drinking quality standards, which often requires the removal of low concentrations of iron, manganese, organic matter, and trace amounts of other metals. When filters are backwashed or when clarifiers are cleaned, the wastewater generated is usually discharged to an outdoor infiltration-percolation basin which ultimately discharges to groundwater. Among other requirements, this permit requires sampling of accumulated sludge from the Infiltration Percolation (IP) lagoon.

Sanitary Subsurface Disposal (Category T1)

Description
This general permit authorizes the discharge of sanitary sewage from existing facilities to a subsurface disposal (i.e. septic) system where the design volume on the property is in excess of 2,000 GPD.

Sanitary Wastewater Discharges from Farm Labor Housing (Category GFLH)

DGW Individual Permits
Sanitary Wastewater Permit

Description
For discharges of sanitary wastewater over 2,000 GPD from various disposal methods, such as septic systems (UIC), lagoons, spray irrigation, or overland flow, a sanitary wastewater permit provides the necessary management practices and monitoring requirements to ensure conformance with the NJPDES regulations and the Ground Water Quality Standards.
Systems classified as underground injection system dispose of wastewater directly into the subsurface. These subsurface disposal systems include disposal beds or trenches, dry wells and seepage pits. UIC discharges are regulated via permits to protect underground sources of drinking water and ensure compliance with state performance standards as well as the Ground Water Quality Standards.

Industrial Wastewater Permit

Description
Discharges of industrial wastewater, such as cooling water, process wastewater, boiler blowdown, and Managed Aquifer Recharge (MAR) injection wells require a permit for the particular disposal method employed by the facility (septic systems [UIC], lagoons, spray irrigation, overland flow, etc.) to ensure conformance with the NJPDES regulations through management practices and monitoring. The individual permit provides the necessary management practices and monitoring requirements to ensure conformance with the NJPDES regulations and the Ground Water Quality Standards.

Managed Aquifer Recharge (formerly Aquifer Storage and Recovery)

Description
Managed Aquifer Recharge (MAR) is a technique for improving groundwater recharge and maintaining aquifer levels to support water storage for drinking water systems or other water needs. MAR can be an effective buffer against future fluctuations in water demand and drought. In the United States, MAR system use has increased for several reasons including water shortages, greater need for reliable seasonal water sources, and favorable costs.
The injection of potable water for future recovery into aquifers requires a permit to ensure compliance with management practices of the injection process and with the Ground Water Quality Standards.

NJPDES Stormwater Discharge (DST) Permits
DST General Permits
Basic Industrial Stormwater General Permit (Category 5G2)

Description
This general permit is available to regulated industrial facilities that have eliminated or can eliminate within 6 months of authorization, all exposure of industrial materials or activities to stormwater discharges (rainfall and snowmelt waters). Exposure may be eliminated by covering the materials or activities or by moving materials or activities indoors.

Concentrated Animal Feeding Operation Stormwater General Permit (Category R8)

Description
This general permit authorizes new and existing discharges from concentrated animal feeding operations and designated animal feeding operations required to obtain a permit pursuant to N.J.A.C. 7:14A-2.13.

Concrete Products Manufacturing Activity Stormwater General Permit (Category CPM)

Description
This general permit regulates industrial stormwater discharges to surface and ground waters of the State from facilities that manufacture concrete or concrete products (block and brick, and ready mixed concrete) or facilities classified as manufacturers of concrete or concrete related products by the DEP.

Construction Activities Stormwater General Permit (Category 5G3)

Description
This general permit authorizes point source discharges from certain construction activities. Regulated entities are required to develop a soil erosion and sediment plan aimed at eliminating the flow of contaminated rainwater into streams and rivers. This general permit is issued through the Local Soil Conservation Districts.

On October 1, 2009, NJDEP launched the Stormwater Construction E-Permitting System. With the implementation of this system, the State Soil Conservation District offices do not accept Stormwater Construction General Permit Request for Authorization (RFA) forms. All RFAs shall be submitted electronically using the NJDEP Online portal to access this electronic application service. Below is guidance and training on how to access the E-Permitting system, as well as guidance materials to aid in the process.

Hot Mix Asphalt Producers Stormwater General Permit (Category R4)

Description
This general permit authorizes stormwater discharges to surface and ground water for facilities engaged in the activity of manufacturing hot mix asphalt defined by SIC 2951 and NAICS 324121.

Mining and Quarrying Activity Stormwater General Permit (Category R13)

Description
This general permit authorizes stormwater and certain process wastewater discharges to surface waters and stormwater-only discharges to groundwater for facilities involved in mining and quarrying operations under SICs 1411, 1423, 1429, 1442, 1446, 1459 (i.e. NAICSs 212311, 212313, 212319, 212321, 212322, 212325, 212319, 212399).
Note: Mining and quarrying activities are not authorized under the Construction General Permit (5G3) NJ0088323 or the Basic General Permit (5G2) NJ088315.

MS4 Tier A Municipal Stormwater General Permit (Category R9)

Description
The Tier A Municipal Stormwater General Permit authorizes the discharge of stormwater from small municipal separate storm sewers. The permit was issued in response to USEPA’s phase II rules. Tier A municipalities are generally located within the more densely populated regions of the state or along or near the coast. The Tier A permit addresses stormwater quality issues related to both new and existing development.

MS4 Public Complex Stormwater General Permit (Category R11)

Description
The Public Complex Stormwater General Permit authorizes the discharge of stormwater from large publicly owned complexes such as colleges, universities, prisons and hospital complexes.

MS4 Highway Agency Stormwater General Permit (Category R12)

Description
The Highway Agency Stormwater General Permit authorizes the discharge of stormwater from highways or other thoroughfares operated by counties or by entities such as the NJ Department of Transportation, NJ Turnpike Authority, and the South Jersey Transportation Authority.

Newark Airport Stormwater General Permit (Category R5)

Description
This general permit regulates the discharge of industrial stormwater from the Newark Liberty International Airport Complex and all its operators that conduct fueling of vehicles, aircraft or equipment; washing of vehicles, aircraft or equipment; maintenance of vehicles, aircraft or equipment and de-icing or anti-icing of vehicles, aircraft or equipment.

Sand and Gravel Stormwater General Permit (Category RSG)

Description
This general permit authorizes stormwater discharges to ground water for facilities involved in sand and gravel mining/quarrying operations.
Sand and gravel operations that were previously authorized under the Mining and Quarrying Stormwater (R13) General Permit but have no discharges to surface water may be eligible for this stormwater general permit.

Scrap Metal Processing/Auto Recycling Stormwater General Permit (Category SM2)

Description
This general permit authorizes the discharge of stormwater from facilities involved in either the recycling of scrap metal materials or the recycling of both scrap metal materials and used vehicle parts. This general permit is available to facilities that meet the eligibility criteria described therein.

Vehicle Recycling Stormwater General Permit (Category RVR)

Description
This general permit authorizes the discharge of industrial stormwater for facilities that engage in vehicle recycling. The ultimate goal of this permit is to have effective best management practices (BMPs), which are documented in the Stormwater Pollution Prevention Plan (SPPP), as well as other permit conditions to ensure adequate stormwater quality.

Wood Waste Recycling and Leaf Composting Stormwater General Permit (Category WRC)

Description
This NJPDES general permit authorizes/regulates stormwater discharges to surface water and ground water from the following activities:
- Recycling activities in which tree branches, tree limbs, tree trunks, brush, and other wood waste that has not been chemically treated, glued, dyed, or painted are received, stored, processed, and transferred. Processing shall be limited to chipping, grinding, screening, and size reduction.
- Composting activities in which grass clippings, leaves, and wood chips (not chemically treated, glued, dyed, or painted) are received, stored, processed, and transferred.

DST Individual Permits
Industrial Stormwater Permit (Category RF)

Description
Individual NJPDES stormwater permits are issued to facilities that cannot eliminate exposure of pollutants to stormwater. These facilities have to develop and implement Stormwater Pollution Prevention Plans to minimize or eliminate contact between pollutants and stormwater. Other permit conditions may require monitoring stormwater discharges for pollutants, and in some cases, effluent limitations may be imposed.

Sludge Quality General Permits for Domestic Treatment Works (Categories S4G, S3G, S2G, S1G, and SXG)

Description
These general permits implement the provisions of the Sludge Quality Assurance Regulations for residual quality and quantity monitoring for Domestic Treatment Works (DTWs). Details regarding each category of permit are provided below:
- S4G – For DTWs that have a permitted flow greater than or equal to 5.0 MGD.
- S3G – For DTWs that have a permitted flow between 1.0 and 4.999 MGD.
- S2G – For DTWs that have a permitted flow between 0.1 and 0.999 MGD.
- S1G – For DTWs that have a permitted flow between 0.02 and 0.099 MGD.
- SXG – For DTWs that generate only domestic septage, or that have a permitted flow of 0.020 MGD or less and that remove all sewage sludge generated to an off-site in-State treatment works treating domestic sewage.

Land Application of Food Processing By-Products General Permit (Category EG)

Description
This general permit authorizes the distribution and land application of food processing by-products for a class of food processing operations. Food processing by-products include residuals (e.g. solids removed during wastewater treatment processes), and vegetative wastes such as peels, skins, and seeds which are left over from trimming, reject sorting, cleaning, pressing, cooking, and other similar food processing operations. Residuals Transfer Facilities General Permit (Category ZG)

Description
This general permit authorizes qualifying residuals transfer facilities that temporarily store liquid sewage sludge (which includes domestic septage) and grease (which meets the definition of a domestic pollutant) prior to transfer to duly permitted or approved residuals management operations for ultimate management. Alternate Design TWA for Septic Systems (issued consistent with N.J.A.C. 7:9A)

Description
This type of Treatment Works Approval (TWA) may be issued when a septic system location, design, construction, installation, alteration or operation does not strictly conform with the requirements in N.J.A.C. 7:9A. The Alternative Design TWA permit is an authorization, in the form of a waiver. It permits the local Health Department to make the final approval. To obtain an Alternative Design TWA from NJDEP, the health department must first review and endorse the septic application.

Description

Procedures
