On February 6, 2023, New Jersey adopted the Mobile Cargo Handling Equipment at Ports and Intermodal Rail Yards rule. For specifics on this adoption and the adopted rule language, see N.J.A.C. 7:27-34.
This rule will help modernize some of the oldest diesel-powered equipment in the State. It will clean up equipment used near some of the most densely populated areas and reduce NOx and particulate matter especially in Environmental Justice communities.
Applicability
Applicability
- Any person who owns or operates a terminal or business at a port in the State and operates cargo handling equipment at that location.
- Any person who owns or operates an intermodal rail yard in the State and operates cargo handling equipment at that location.
- Any person conducting business in the State who sells, offers for sale, leases, rents, or purchases any cargo handling equipment or engine that is used at any port or intermodal rail yard in the State.
- Excludes low throughput facilities over 75 miles from urban areas
- Extension for low use cargo handling equipment
- Extension for manufacturing delay
- Extension for over compliance with ZEV
Reporting
Reporting
- All regulated businesses at ports and railyards, as defined above under Applicability, must report on their Cargo Handling Equipment inventory as of January 1, 2024 by November 1, 2024 via the DEP Online Services Portal.
- Data to include: equipment make, model, year, and engine size and tier
- Usage data shall be from 2023
- Usage data to include: hours of use, fuel usage, and seasonality if applicable

- Follow the instructions on the Instructions Tab in the spreadsheet and in the pop-up boxes that appear as you navigate through the Equipment Tab
- Once complete, submit the spreadsheet through the NJDEP Online Services portal using the Cargo Handling Equipment service.

If you wish to apply for an alternative compliance option – BACT or fleet averaging, or a compliance extension – manufacturer delay, low use, or ZEV replacement, or need to transfer non-yard trucks between two of your facilities, you will need to complete and submit the appropriate form to the Department for approval. All forms are available for download at the links below.
Once you have completed the form and gathered all other required documentation, send it as attachments to a single email to StopTheSoot@njdepwptest.net with the appropriate subject line as follows:
- “CHE Alternate Compliance Application”
- “CHE Compliance Extension Application”
- “CHE Non-Yard Truck Transfer Application”
While it is highly recommended to send your complete application with all required attachments in a single email to avoid the potential of items being misplaced or not clearly attributed to your application, we understand that it may at times be necessary to send additional documentation separately. In this case, please clearly indicate in the email body that this is a secondary submittal and include the date and time of your original email to ensure that it is properly received.
Each form provides instructions on what information and what additional documentation is required however it is the applicant’s responsibility to review and understand the full rule requirements for the process for which you are applying. New equipment
Starting 3/1/2025, must be Tier 4F or the current model year on-road.
Existing equipment
The Phase-in Schedule is based on CARB rule and moving to Tier 4F which is a mature technology on the market for over 10 years.
