Outer Continental Shelf Air Rules, N.J.A.C. 7:27-30


The New Jersey Department of Environmental Protection has adopted new Air Pollution Control rules at N.J.A.C. 7:27-30. Currently, the US Environmental Protection Agency (EPA) has the authority to issue and enforce air permits for sources of air pollution on the outer continental shelf (OCS). The adopted rules would incorporate by reference the relevant provisions of 40 CFR Part 55, which set forth the air pollution control requirements that are intended to protect ambient air quality standards and ensure compliance with the requirements of the Clean Air Act for the prevention of significant deterioration of air quality on the OCS. The Department’s adoption, which incorporates the Federal rules by reference, fulfills one of four prerequisites necessary for the Department to seek delegation of the EPA’s authority to issue and enforce air permits on the OCS. Please note that these rules will not be applicable to owners or operators of OCS sources unless or until the EPA approves a delegation request from the State of New Jersey.
