N.J.A.C. 7:27F-3.2 “Carbon Standard for Fuels” LISTSERV Announcement
This notification is being issued as a reminder for facilities that are authorized to combust Number 4 fuel oil or Number 6 fuel oil in any New Jersey Air Pollution Control (APC) Preconstruction Permit, issued pursuant to N.J.A.C. 7:27-8, or New Jersey Air Pollution Control (APC) Operating Permit, issued pursuant to N.J.A.C. 7:27-22.
N.J.A.C. 7:27F “Control and Prohibition of Carbon Dioxide Emissions” became effective on January 23, 2023. A courtesy copy of the N.J.A.C. 7:27F can be accessed at njac7-27f.pdf.N.J.A.C. 7:27F-3.2 “Carbon Standard for Fuels” restricts the combustion of Numbers 4 and 6 fuel oils and states the following:
No person shall store, offer for sale, sell, deliver, or exchange in trade, No. 4 fuel oil or No. 6 fuel oil, for purposes of combustion in New Jersey on or after January 31, 2023, except that No. 4 fuel oil or No. 6 fuel oil that was stored in New Jersey before January 31, 2023, may be combusted used, stored, offered for sale, sold, delivered, or exchanged in trade, in New Jersey, for two years after January 31, 2023.
As APC Permits are modified and renewed, the Department will be updating the operating requirements in the compliance plans to incorporate the N.J.A.C. 7:27F-3.2 prohibitions. However, the N.J.A.C. 7:27F-3.2 prohibitions supersede and take precedence over any permits with a compliance plan that allows for the combustion of Number 4 and 6 fuel oils.
