Notice of Proposed State Implementation Plan (SIP) Revision:

Memorandum of Agreement for the Implementation of New Jersey’s NOx State Implementation Plan (SIP) Call Requirements under 40 CFR 51.121(r)(2) between the New Jersey Department of Environmental Protection and the United States Environmental Protection Agency, Region 2

Take notice that the State of New Jersey is proposing a revision to its State Implementation Plan (SIP) by entering into a Memorandum of Agreement (MoA) with the United States Environmental Protection Agency (USEPA) for the Implementation of New Jersey’s NOx State Implementation Plan (SIP) Call Requirements under 40 CFR 51.121(r)(2).

The purpose of this MoA as a SIP revision is to ensure the continued compliance with the NOx SIP Call under 40 CFR 51.121(r)(2) for the non-Electric Generating Units through the NOx Budget Program. The compliance for the affected Electric Generating Units (EGUs) were subsequently covered by Federal regulations, including but not limited to, the Clean Air Interstate Rule (2009) and Cross-State Air Pollution Rule (2015).

The New Jersey Department of Environmental Protection intends to submit the final signed MoA to the USEPA as a revision to New Jersey’s SIP in accordance with CAA requirements.

A public hearing concerning the Department’s proposed SIP revision will be conducted only if requested in writing by November 18, 2024, using the same instructions as below for emails, regular mail, and courier service.  If no request for a public hearing is received, the hearing will be cancelled by a notice posted on the Department’s website at NJDEP| Air Planning | State Implementation Plan (SIP) Dashboard.  If a public hearing is requested, it will be held in-person on December 5, 2024, at 10:00am. The location of the in-person public hearing will be held at 401 East State Street, Trenton, NJ, in the 3rd Floor Large Conference Room.  The information for the in-person public hearing will also be posted on the Department’s website at NJDEP| Air Planning | State Implementation Plan (SIP) Dashboard.
