Notice for the Commissioner’s Release of Conservation Restriction – 1112-04-0011.1 LUP220001

REQUEST TO RELEASE CONSERVATION RESTRICTION
PUBLIC HEARING

TAKE NOTICE that, in accordance with the New Jersey Conservation Restriction and Historic Preservation Restriction Act, N.J.S.A. 13:8B-5, the New Jersey Department of Environmental Protection, Division of Land Resource Protection (the “Department”) has received an application for a partial release of a Conservation Restriction/Declarations of Environmental Restrictions by Blake Spencer of Johnson Development Associates, Inc., for the property identified identified as Block 41.01, Lot 31 (and now, or also known as Lots 31.01, 31.02 & 31.03). The lot is shown on the official tax map of Robbinsville in Mercer County, New Jersey, and is partially developed with stormwater management features, a commercial building and parking lot, and undeveloped areas.

A portion of the property was deed restricted as part of a Freshwater Wetlands Permit (File No. 1112-04-0011.1 FWW040001-3), approved by the Department on August 2, 2006, for construction of a commercial development with stormwater management and parking. The applicant proposes to construct new commercial buildings.  The project will result in disturbances to deed restricted stormwater management areas.

To offset the proposed disturbances to deed restricted areas, the applicant has proposed to meet the requirements of N.J.A.C. 7:8 Stormwater Management Rules using new best management practices.

Mitigation Technical Manual

Mitigation Technical Manual Now Available from the Department of Environmental Protection

The DEP is pleased to announce the release of the Mitigation Technical Manual. Developed by staff from Watershed and Land Management and funded by a Wetland Program Development Grant from EPA Region 2, this manual provides comprehensive guidance for mitigating for impacts to wetlands and their transition areas, riparian zones, intertidal and subtidal shallows, shellfish habitat, and submerged aquatic vegetation. The manual explains what mitigation is, the various types of mitigation available, the regulatory requirements for mitigation, how to select a suitable mitigation location and design a mitigation project, and protocols to follow when monitoring the progress of a mitigation site. The manual also discusses how to establish a wetland mitigation bank. In addition, the manual incorporates lists of regional wetland species, common invasive species, and native species typical of specific wetland types and regions of New Jersey. This Mitigation Technical Manual is a valuable resource for consultants, mitigation bankers, and others interested in mitigation and should contribute to a higher level of success of mitigation and banking projects and an improvement in the ecological returns from mitigation efforts in New Jersey.

Tidelands New Application

The Tidelands New Application service is now available for new submissions of licenses.

A Tidelands License is a short term rental agreement from the State of New Jersey for the use of its currently flowed tidelands.

Licenses must be procured for the following uses:

 

  • Fixed structures (i.e. docks, piers, mooring piles, floating docks, boat lifts, riprap, etc) constructed on currently flowed tidelands
  • Bulkhead extensions that exceed or will exceed the mean high water line (As formerly flowed tidelands, bulkhead extensions may be purchased from the State if desired; however, they must be rented via a valid License until a Riparian Grant is delivered.)
  • Marina slips (defined as five or more rented boat slips)
  • Yacht and Boat Club structures
  • Dredging within state-owned tidal water
  • Utilities or Utility-related structures (i.e. pipes, cable lines) that cross over or under state-owned tidelands
  • Bridge construction/maintenance over state-owned tidelands

 

Before proceeding, please ensure that you have an electronic version of your recorded deed available as it will be required to complete the submission.

Mandatory Electronic Submissions for DLRP Applications

Announcing Mandatory Electronic Submissions for DLRP Applications Starting October 5, 2021

The New Jersey Department of Environmental Protection’s Division of Land Resource Protection (formerly the Division of Land Use Regulation) announces that all applications for the following land use permits and authorizations must be submitted electronically through NJDEP Online, effective October 5, 2021:

  • Coastal General Permits and CAFRA, Coastal Wetlands and Waterfront Development Individual Permits
  • Meadowlands District Water Quality Certificates
  • Flood Hazard General Permits, Individual Permits, and associated Flood Hazard Verifications

(Note: Applications for verifications can only be submitted electronically if the verification is associated with an application for a general permit authorization, an individual permit, or a transition area waiver. Application for stand-alone verifications must be submitted by mail.)

  • Freshwater Wetlands General Permits, Individual Permits, and Transition Area Waivers

 

Please note that paper applications for the authorizations and permits listed above will NOT be accepted after October 5, 2021.

The electronic submission of applications provides numerous benefits, including improving the efficiency of the application process, increasing transparency for the public, reducing costs, and protecting the environment by eliminating the need for paper.

Public hearing deed lifting Rebuild by Design

TAKE NOTICE that, in accordance with the New Jersey Conservation Restriction and Historic Preservation Restriction Act, N.J.S.A. 13:8B-5, the New Jersey Department of Environmental Protection (DEP), Division of Land Resource Protection (DLRP) has received a request for a release of a Conservation Restriction/Declaration of Environmental Restrictions by the New Jersey Department of Environmental Protection, Bureau of Climate Resilience Design and Engineering (BCRDE), dated March 16, 2021, on the property identified as 10 Caesar Place (Block 63, Lot 5). The lot is shown on the official tax map of the Borough of Moonachie in Bergen County, New Jersey. As part of the Federally funded Rebuild by Design Meadowlands (RBDM) Flood Reduction Project, BCRDE proposes to deepen and widen approximately 4,200 linear feet of the East Riser Ditch (ERD) Channel starting from Starke Road in Carlstadt to Moonachie Avenue in Moonachie. The channel improvements are designed to increase channel capacity while providing structural stability and ecological uplift in the East Riser Ditch.

The 10 Caesar Place property is located adjacent to the proposed ERD channel improvements, it is partially developed with a commercial development that includes an industrial building and parking lot bordered to the north by a grassy/partially wooded area.

A Flood Hazard Area (FHA) Emergency Permit [0237-11-0002.1 FHA110001 (IP)] and Freshwater Wetlands (FWW) Emergency Permit [0237-11-0002.1 FWW110001 (IP)] was issued to the property owners of 10 Caesar Place from the DEP DLRP on October 18, 2011, authorizing removal of trees in the 50-foot riparian zone of East Riser Ditch. A FHA Individual Permit (IP) was issued to the property owner of 10 Caesar Place, Moonachie on January 30, 2012. As a condition of approval, the FHA IP required onsite restoration of 0.673 of an acre of forested riparian zone and also required protection of this area through signing and filing a conservation restriction with the deed in the office of the County Clerk.

The RBDM project will result in a disturbance of the deed restricted 0.673 acres of forested riparian zone on the property located at 10 Caesar Place. To offset the proposed disturbance to deed restricted areas, BCRDE proposes to preserve a 0.673 acre area in turn, on the same site immediately adjacent to the current deed restricted area once the RBDM project is constructed. DEP’s perpetual easement on the property would include the entire 0.673 acre restoration area.

The proposed riparian zone will consist of native tree and shrub plantings suitable for the conditions in the replacement location. Due to the proximity of Teterboro Airport, proposed plant species will adhere to guidelines published by the Federal Aviation Administration (FAA) and the Port Authority of New York and New Jersey (PANYNJ). Establishment of native plantings in this area will enhance the characteristics of the riparian zone and wetland.
