About Coastal and Land Use Compliance & Enforcement

The Bureau of Coastal and Land Use Compliance & Enforcement (CLUE) is responsible for enforcing six (6) environmental protection statutes: the Waterfront and Harbor Facilities Act; the (Coastal) Wetlands Act of 1970; the Coastal Area Facilities Review Act; the Flood Hazard Area Control Act; the Freshwater Wetlands Protection Act; and the Highlands Water Protection and Planning Act.  All of these statutes provide authority for the New Jersey Department of Environmental Protection to regulate development (including clearing of vegetation and filling) within environmentally sensitive areas such as beaches, dunes, wetlands and floodplains.

Our Role

  • Respond to reports of possible DEP land use violations received by the Communication Center/hotline/WARN DEP app.
  • Investigate unauthorized DEP land use activities
  • Conduct compliance inspections of DEP land use permits to ensure compliance with their conditions, requirements, and limitations.
  • When DEP land use violations are confirmed, issue enforcement documents compelling compliance and follow up with property owners to ensure either issuance of an DEP land use permit, if possible, and/or restoration of the site to resolve the violation.
  • Provide compliance assistance to the public
  • Conduct education and outreach programs to all levels of government, organizations, and citizens on the technical aspects of the rules regulating development in areas under Land Resource Protection jurisdiction
