The attached report is posted in order to comply with the Public Record provisions of the Federal Energy Policy Act of 2005 (EPAct). In accordance with EPAct, this report will be posted not later than December 31st of each year and will cover the preceding data collection period from October 1st through September 30th.   Please note that the information provided is specific to the state and\or federal regulated underground storage tank universe in New Jersey as indicated.

These reports include remedial and non-remedial information on sites subject to the Underground Storage of Hazardous Substances Act. Remedial information would include soil and/or ground water remediation information. The non-remedial information would focus on regulated facilities, active facilities with compliant tanks and other administrative data.

1. General Information

Total Number Of Federally Regulated UST Facilities: 3,921

Total Number Of Federally Regulated USTs: 12,483

Total Number of State Only Regulated USTs: 263

This information is based on all active underground storage tank systems, both Federal & State regulated, as required by N.J.A.C. 7:14B-1 et seq [pdf].

2. Summary Information for On-Site Inspections

Total Number Of UST Facilities Inspected: 1,378

Inspection Period Dates: Oct 1, 2022  to  Sept 30, 2023

Percent Compliance w/Release Detection & Prevention Measures = 94.69%

Tank, facility and on-site inspection information is based upon data submitted in accordance with the regulated UST registration requirements (see N.J.A.C. 7:14B-2) and data collected from Standard Compliance Inspections being conducted at every regulated UST facility. It has been the NJDEP’s goal since 2005 to inspect each UST facility once every three years. Technical Compliance Rates at UST facilities measure compliance with state regulations (N.J.A.C. 7:14B-1 et seq.) that are equivalent to the USEPA’s UST performance measures that define Technical Compliance Rates for Release Prevention and Release Detection. Standard Compliance Inspections are conducted by NJDEP staff pursuant to the County Environmental Health Act.

Releases Reporting Period Dates: Oct 1, 2023  to  Sept 30, 2024

The referenced report below Federal UST Releases FY24 (see link) enables the requestor to view information regarding the total number of confirmed releases from federally regulated underground storage tank (UST) systems for federal fiscal year 2024: October 1, 2023 to September 30, 2024. The Federal Energy Policy Act of 2005 requires the NJDEP to report on the various sources and causes of releases from federally regulated UST systems.
