Important Notice – NJDEP Petroleum Underground Storage Tank Remediation, Upgrade & Closure Fund (Ust Fund)

Please be advised that new applications for leaking Unregulated USTs (which includes all residential Heating Oil USTs) will continue to be accepted and acknowledged, but shall not be reviewed or processed at this time. They will be date stamped at the time of receipt and processed when funding becomes available. Currently there is a 3.5 year wait on all new applications being received by the Department of Environmental Protection. In addition, effective May 3, 2011, the UST Fund will no longer accept or process Non-leaking UST Fund applications due to insufficient funds. The Department of Environmental Protection is aware that contractors advertise that state funding is available and that tank removal and remediation can be done at no cost to homeowners. However, the UST Fund has never guaranteed funding for applicants to this program.

Please Note That This Does Not Affect Supplemental Funding Requests. If your application has already been approved and funding provided, any supplemental funding request for that application shall be processed, assuming sufficient funding is available.

Please note that effective July 1, 2010, the UST Fund discontinued accepting new Regulated UST Fund applications. However, if a regulated tank is newly discovered, the UST Fund will accept an application in this situation, if the owner/operator files their application for a newly discovered and previously unregistered regulated tank within 18 months from the date of discovery. This deadline does not affect supplemental UST Fund applications for regulated or unregulated (residential heating oil tank) applications.

UST Fund Background

On August 30, 1997, Governor Whitman signed the law establishing the Petroleum Underground Storage Tank Remediation, Upgrade and Closure Fund (UST Fund) within the New Jersey Economic Development Authority (NJEDA) and administered jointly with the New Jersey Department of Environmental Protection (NJDEP).

The UST Fund was created to provide financial assistance to eligible owners and operators of leaking petroleum underground storage tanks The UST Fund statute was amended in 2003, 2006, 2007 and 2009.

Be advised that as of October 3, 2006, due to the enactment of P.L. 2006, c.58, all contractors performing work on non-regulated underground storage tanks, including homeowner heating oil tanks, where work is being funded by the Petroleum Underground Storage Tank Remediation, Upgrade & Closure Fund, must be certified in accordance with N.J.A.C. 7:14B-13.
