Public Notice
Take notice that the NJ Department of Environmental Protection (Department) and the Commission on Radiation Protection (Commission) are proposing amendments to N.J.A.C. 7:28-3.12, 14.1, 14.2, 14.3, 14.4, 15.2, 15.3, 15.4, 15.5, 15.9, 15.10, 16.2, 16.3, 16.9, and 16.10. The Department and Commission are also proposing the promulgation of new rules at N.J.A.C. 7:28-14.6, 16.7, and 16.8, and the recodification with amendments of N.J.A.C. 7:28-15.6 and 15.12 as 14.5 and 15.6, respectively.
The proposed amendments, new rules, and recodifications will update the Radiation Protection Program rules for therapeutic installations, medical diagnostic X-ray installations, and dental radiographic installations to incorporate current technologies, allow flexibility to address emerging and future technologies, and incorporate the latest applicable Federal guidance to reflect national standards in radiation protection. The proposed rulemaking also includes amendments to the annual registration fee tables and requirements at N.J.A.C. 7:28-3.12.

A public hearing concerning the proposal will be conducted virtually via the Department’s video conferencing software, Microsoft Teams on June 18, 2025, at 1:00 P.M.

If you are interested in providing oral comments at the virtual public hearing, please email the Department at jennifer.daino@dep.nj.gov no later than 5:00 P.M. on June 16, 2025, with your contact information (name, telephone number, email address, and if applicable, the name of the organization on behalf of which you are speaking). You must provide a valid email address so the Department can send you an email confirming receipt of your interest to testify orally at the hearing and provide you with a separate option for a telephone call-in line if you do not have access to a computer or mobile device that can connect to Microsoft Teams.
Written comments are due by July 18, 2025. The Department encourages electronic submittal of comments. Written comments may be submitted electronically at https://njdepwptest.net/rules/rule-comment-form/. In the alternative, comments may be submitted on paper to:
