Proposed New Rules: N.J.A.C. 7:26K

Take notice that the NJ Department of Environmental Protection is proposing the promulgation of new Food Waste Recycling rules at N.J.A.C. 7:26K.
The Department is proposing a new chapter entitled Food Waste Recycling, N.J.A.C. 7:26K, to implement N.J.S.A. 13:1E-99.122 et seq. governing the source separation and recycling of food waste by certain businesses identified as large food waste generators. The proposed rules prescribe recordkeeping and reporting requirements for both authorized food waste recycling facilities and large food waste generators. Authorized food waste recycling facilities will also be subject to provisions covering economic benefit for municipalities. The proposed rules include waiver provisions for source separation and recycling and enforcement provisions. The notice of proposal is scheduled to be published in the New Jersey Register dated August 5, 2024.
