Notice of Proposed Readoption with Amendments:
N.J.A.C. 7:1D and Appendix A

PUBLIC NOTICE
Take notice that the NJ Department of Environmental Protection is proposing to readopt its General Practice and Procedure rules at N.J.A.C. 7:1D with amendments.  A statement of the substance of the proposal follows: The rules establish the procedure for the public to petition the Department for rulemaking; govern the debarment, suspension, or disqualification of persons from contracting with the Department, including the procedure and scope of such action; and establish the circumstances under which the Department will extend the public comment period on a rule proposal, hold a public hearing on a rule proposal, and provide notice of rulemaking to the public.  Appendix A to the chapter contains the Department’s Mapping and Digital Data Standards.  The Department proposes amendments to update contact information, allow the Department and the person submitting a petition for rulemaking to agree to an extension of time for the Department to refer the matter for further deliberations and/or initiate rulemaking; and to modify the manner in which public notice of rulemaking is provided.

The proposal is scheduled to be published in the New Jersey Register dated February 7, 2011.  A copy of the proposal is available from:  the DEP website (PDF) and LexisNexis Customer Service at (800)223-1944 or www.lexisnexis.com/bookstore.  Be advised that there may be a fee for obtaining a copy of the proposal from some sources.
