Take notice that the NJ Department of Environmental Protection is proposing changes in the fees for the Solid Waste Rules, Recycling Rules and Hazardous Waste Rules. A statement of the substance of the proposal follows:
N.J.A.C. 7:26-3A.8, 4.2-4.5; 7:26A and 7:26G-3.3g identify the regulations that support fees for solid waste, regulated medical waste and hazardous waste; respectively. The Department is statutorily empowered by the Solid Waste Management Act (Act) at N.J.S.A. 13:1E-18 to assess the regulated community solid waste and hazardous waste facility fees for the services it performs. The Department is proposing to amend the solid and hazardous waste rules to ensure that the fees capture the Department’s true costs of providing services to the regulated community. The last major fee revisions were promulgated in 2003. Therefore, the Department reviewed its current fee structure and future revenue predictions and determined that amendments to its fee provisions are necessary to reflect changes in costs attributable to its solid waste sanitary landfill facilities, compost facilities, regulated medical waste, hazardous waste facilities, and hazardous waste generators and transporter services.
The proposal is scheduled to be published in the New Jersey Register dated December 18, 2006.
