Board of Tree Experts

APPOINTMENT TYPE: Governor w/ Advice and Consent of the Senate
BOARD CATEGORY: Division of Parks & Forestry
PURPOSE: There is established in the Department of Environmental Protection the New Jersey Board of Tree Experts. The board shall: a) review the qualifications of an applicant for licensure under the act; b) establish standards for examinations for licensure; c) issue and renew licenses and assess fees therefor; d) establish standards by regulation, which shall include, but not be limited to, the appropriate standards of the American National Standards Institute, and any related standards and best management practices; e) suspend or revoke licenses or registrations for violations of the act; f) maintain a registry of licensees; g) adopt a canon of professional ethics; h) adopt such regulations as may be necessary to effectuate the purposes of the act; i) establish fees by regulation for examinations, applications for licensure, and license renewals. The fees shall be sufficient to defray expenses incurred by the board in the performance of its duties under the act; j) conduct such worksite inspections as may be necessary to enforce the provisions of this act; and k) maintain a registry of businesses engaged in tree care services, and charge a fee therefor.
SEAT RESTRICTIONS: The board shall consist of nine members, including the Commissioner of the Department of Environmental Protection or the Commissioner’s designee, who shall serve ex officio, and eight members appointed by the Governor with the advise and consent of the Senate as follows: five shall be licensed tree experts, two shall be licensed tree care operators, and one shall possess knowledge of arboriculture or forestry, including urban forestry. However, of the public members first appointed, three of the five licensed tree expert memberships shall be appointed from the members of the board of tree experts established by P.L. 1940, c. 100, participating on the board on the date of enactment of this act, and the remaining tree experts first appointed shall be certified, on or before the date of enactment of this act, pursuant to the provisions of P.L. 1940, c. 100. The initial members of the board, including the tree care operators first appointed, need not be licensed until 180 days following the promulgation of initial regulations by the board to carry out the provisions of this act. Thereafter, the members of the board subsequently appointed shall be licensed before appointment.

PURPOSE: Under Title 26 Health and Vital Statistics 26:2C-3.2, the Clean Air Council is charged with advising the Commissioner of the Department of Environmental Protection on matters related to Air Pollution Control and Prohibition.
SEAT RESTRICTIONS: The membership shall include the following: 6 members of the general public appointed by the Governor – at least 1 of whom shall be a medical doctor licensed to practice in the State; 8 members appointed by the Governor and nominated by the following organizations – the New Jersey Health Officers Association, the New Jersey State Chamber of Commerce, the New Jersey Society of Special Engineers, the New Jersey Manufacturers Association, the New Jersey Section of American Industrial Hygiene Association, the New Jersey State League of Municipalities, the New Jersey Association of Counties, and the New Jersey State AFL-CIO; and the following 4 ex officio members the Executive Director of the New Jersey Commerce Commission (formerly the Chief Executive Officer and Secretary of the New Jersey Commerce and Economic Growth Commission), the Commissioner of the Department of Community Affairs; the Secretary of Agriculture: and the State Commissioner of Health or a member of his staff designated by him to be a member of the council. At least one month prior to the expiration of an organization member’s term, each organization shall submit to the Governor a list of three recommended nominees. From this list, the Governor shall appoint one member. If any organization does not submit a list of recommended nominees at any time required by the statute, the Governor may appoint a member of his choice.

Commission on Radiation Protection

PURPOSE: The Legislature established the Commission on Radiation Protection within the Department of Environmental Protection. The Commission has the power to formulate, adopt, amend and repeal rules and regulations in order to prevent the unnecessary release of radiation into the atmosphere. In addition, the Commission is authorized to review the policies and programs involving radiation promulgated by the Department of Environmental Protection and make recommendations to the Commissioner affecting such.
SEAT RESTRICTIONS: Of the 10 members 7 members shall be appointed by the Governor with the advice and consent of the Senate. The members backgrounds shall include: medicine; radiology; nonionizing radiation; infrasonics; ultrasonics; radiation physics; medical physics; epidemiology; atomic energy; and biology or engineering. Clean Water Council

PURPOSE: The Legislature established the Clean Water Council within the Department of Environmental Protection. The Council shall consider any matter relating to the preservation and improvement of the State’s water pollution control program and advise the Commissioner of Environmental Protection accordingly. In addition, the Council shall study the regulations promulgated by the Department of Environmental Protection with regard to water pollution control and make recommendations for improvement to the Commissioner.

Delaware and Raritan Canal Commission

PURPOSE: The Legislature established the Delaware and Raritan Canal Commission within the Department of Environmental Protection. The Commission is empowered to prepare a master plan for the physical development of the Delaware and Raritan Canal State Park, which includes the Delaware and Raritan Canal and adjacent lands along the Canal banks.
SEAT RESTRICTIONS: The Commission consists of nine members:The Commissioner of the Department of Environmental Protection, who serves ex officio; or a designee of the Commissioner, who may lawfully vote in the Commissioner’s absence; and Eight citizens of the State, appointed by the Governor, with the advice and consent of the Senate. No more than four commissioners shall be of the same political party. At least four of the commissioners shall be residents of Hunterdon, Mercer, Middlesex and Somerset, counties. One commissioner must also be a mayor of a municipality appertaining to the Delaware and Raritan Canal State Park. Not more than one commissioner can be appointed from any one municipality.

Drinking Water Quality Institute

PURPOSE: The Legislature established the Drinking Water Quality Institute in the Department of Environmental Protection. The Institute shall make recommendations for the implementation of the Drinking Water Quality Program supervised by the Department of Environmental Protection regarding 1.) The development of a list of contaminants for which testing is required; 2.) The development of maximum contaminant levels; 3.) The development of appropriate testing techniques to measure maximum contaminant levels; 4.) The development of testing frequencies; and 5.) The review of all activities undertaken pursuant to the “Safe Drinking Water Act.”
SEAT RESTRICTIONS: The membership shall include the following: 3 public members appointed by the Governor, each representing one these three areas – water purveyors, the academic/scientific community, and environmental health; 3 public members appointed by the Senate President, each representing one these three areas – water purveyors, the academic/scientific community, and environmental health; and 3 public members appointed by the Assembly Speaker, each representing one of these three areas – water purveyors, the academic/scientific community, and environmental health. Endangered and Nongame Species Advisory Committee

PURPOSE: This Committee is responsible for reviewing wildlife conservation, land use and resource management issues, including Department of Environmental Protection policies and decisions that affect nongame, threatened and endangered wildlife species in the State, and when appropriate, makes recommendations. Among the principal functions of the Committee is to provide scientific guidance and oversight for the research, monitoring and management activities of the Endangered and Nongame Species Program including recommendations regarding the conservation status of wildlife species.

Fish and Game Council

PURPOSE: The Legislature established the Fish and Game Council within the Division of Fish and Wildlife in the Department of Environmental Protection. Subject to the approval of the Commissioner of the Department of Environmental Protection, the Council shall formulate comprehensive policies for the protection of fish, birds and game animals, as well as for the propagation and distribution of food fish. Furthermore, it shall be responsible for maintaining a sufficient supply of fish for the waters of this State. In addition, the Council shall consult with and advise the Commissioner and the Director of the Division with respect to the work of the Division. It shall also study the activities of the Division and hold hearings with respect to its work. The Council shall annually report to the Governor and the Legislature with regard to its findings and conclusions.
SEAT RESTRICTIONS: Of the 11 members, 10 members shall be appointed by the Governor with the advice and consent of the Senate as follows – 3 farmers recommended by the agriculture convention, 6 sportsmen recommended by the New Jersey State Federation of Sportsmen’s Clubs, and 1 person knowledgeable in land use management and soil conservation practices. Of the members appointed by the Governor with the advice and consent of the Senate, 1 farmer representative and 2 sportsmen representatives shall be chosen from among residents from each of the following 3 regions – North Jersey — Bergen, Essex, Hudson, Morris, Passaic, Sussex and Warren Counties; Central Jersey — Hunterdon, Mercer, Middlesex, Monmouth, Ocean, Somerset and Union Counties; and South Jersey — Atlantic, Burlington, Camden, Cape May, Cumberland, Gloucester and Salem. In addition to the above the Council shall also include the Chair of the Endangered and Nongame Species Conservation Act.

Food Waste Recycling Market Development Council

PURPOSE: The Food Waste Recycling Market Development Council is charged with preparing a report for the Governor and Legislature within 18 months of enactment (enacted April 14, 2020) which includes: the identification of existing markets for any products and energy produced from food recycling facilities, food waste composting facilities, and anaerobic and aerobic digestion facilities that accept food waste material (facilities); the feasibility of providing preferences for products or energy produced from these facilities in the State procurement process, including how to stimulate the use in public projects of compost or soil amendment products derived from these facilities; and provide recommendations on changes needed to State laws or rules or regulations to stimulate the market for products and energy produced at these facilities.
SEAT RESTRICTIONS: The twelve-member Council is to be comprised of the Commissioner of Environmental Protection, the President of the Board of Public Utilities, the Commissioner of Transportation, the Secretary of Agriculture, the State Treasurer, and the Attorney General, or their designees, and six citizen members appointed by the Governor from the following fields: Two members actively engaged in the composting industry, of whom; one shall be a representative of the National Waste and Recycling Association and one shall be a representative of the National Biosolids Partnership or equivalent entities; Two members actively engaged in the recycling or solid waste collection industry, of whom; one shall be a representative of the Association of New Jersey Recyclers (ANJR) or equivalent entities, and; Two members to represent the general public.

The council shall: (1) study and track the eastward spread of Sudden Oak Death and the impact and spread of Bacterial Leaf Scorch and other potential forest health issues; (2) evaluate New Jersey’s susceptibility to these forest health issues and their impact on New Jersey’s forests and community trees; (3) make recommendations to the Commissioner of Environmental Protection and officials of other appropriate State departments and agencies regarding prevention, management, treatment, control and spread of forest health issues; (4) conduct research, as necessary, on forest health issues, and seek advice, counsel and resources from State and federal sources to address them; and (5) conduct a public outreach and education program to inform the public about forest health issues. The council shall annually submit a written report of its findings and recommendations, including any recommended legislation, to the Governor, the President of the Senate, and the Speaker of the General Assembly, and to the chairpersons of the Senate Environment Committee and the Assembly Agriculture and Natural Resources Committee, or their successor committees.
SEAT RESTRICTIONS: The council shall be composed of 10 members, as follows: the Commissioner of Environmental Protection, or a designee, who shall serve ex-officio; the Secretary of Agriculture, or a designee, who shall serve ex-officio; the Director of the Division of Parks and Forestry in the Department of Environmental Protection, or a designee, who shall serve ex-officio; the chairperson of the Department of Plant Biology and Pathology at Cook College, Rutgers, the State University, or a designee, who shall serve ex-officio; and six public members, who shall be residents of the State, appointed by the Governor with the advice and consent of the Senate. NJ Living History Advisory Council

PURPOSE: The New Jersey Living History Advisory Council is dedicated to improving the safety, authenticity, and public awareness of living history events throughout the State. It encourages cooperation among New Jersey’s public and private historical organizations in their presentation of living history programming. Through its outreach efforts, the Council also raises public awareness and appreciation of the state’s multi-faceted history. In its advisory role, the Council provides guidelines and standards for planning and presenting living history programs and military reenactments. It has recently completed safety guidelines for black powder usage at reenactments and is currently working on a “how-to guide” for those organizations interested in developing living history events.

PURPOSE: The Legislature established the Radiologic Technology Board of Examiners within the Department of Environmental Protection. The Board is responsible for establishing criteria and standards for chest, podiatric, and dental radiology programs. In addition, the Board shall issue a license to each candidate who has successfully passed the examination and has fulfilled the statutory requirements.

Recycling Market Development Council

PURPOSE: The Council is charged with issuing to the Governor and Legislature a report on existing recycling markets, developing best management practices to improve the State’s market, increasing the competitiveness of the State as an exporter of recyclable materials, and making recommendations on changes to State laws or regulations to stimulate the creation of processing facilities and manufacturers of products with recycled content. The Council will expire following the issuance of the report.

Shellfisheries Council

PURPOSE: The Legislature established the Shell Fisheries Council within the Department of Environmental Protection. The Council shall formulate comprehensive policies for the preservation and improvement of the shell fish industry and resources of the State. The Council shall also consult with and advise the Commissioner of Environmental Protection and the Marine Fisheries Council with respect to the implementation of its programs. Finally, the Council shall initiate by resolution rules and regulations concerning shell fish.
SEAT RESTRICTIONS: **Financial Disclosure Required** The membership shall include the following: 7 members, 1 each from the counties of Monmouth, Ocean, Burlington, Atlantic and Salem and 2 residents of Cape May county; and 3 members from the county of Cumberland. Each member of the Council shall be a licensed and practicing fisherman and shall be chosen as a member with regard to his/her interest in and knowledge of the shell fish industry and the conservation and management of shell fish. The Council shall be divided into 2 sections: one section to be known as the “Delaware Bay Section” consisting of the members from the Counties of Cumberland and Salem and one of the members from Cape May county; and the other section to be known as the “Atlantic Coast Section” consisting of members of the Counties of Atlantic, Burlington, Ocean and Monmouth and one of the members from Cape May. In the event only one member from Cape May county has been appointed and has qualified as a member of the Council, the qualified member may elect to serve in both sections of the Council and participate in the exercise of the powers and performance of the duties of each of the sections until a second member from Cape May county has been appointed and has qualified as a member of the Council.

Site Remediation Professional Licensing Board

PURPOSE: The primary function of the Site Remediation Professional Licensing Board is to establish licensing requirements and oversee the licensing and performance of site remediation professionals. The duties of the Board are described in Section 5 of SRRA as follows: review and approve or deny applications for licensing site remediation professionals; administer and evaluate licensing examinations for site remediation professionals; issue licenses and license renewals; establish standards and requirements for continuing education of LSRPs;
approve or offer continuing education courses, and track fulfillment of continuing education requirements by LSRPs; establish and collect fees for examinations, licenses, renewals, or any other services required for the licensing of site remediation professionals; adopt and administer standards for professional conduct for LSRPs; investigate complaints, impose discipline, and suspend and revoke licenses of site remediation professionals who violate the provisions of SRRA; publish and maintain the names and contact information of LSRPs, and a list of site remediation professionals whose license has been suspended or revoked by the board; provide public information on the LSRP program; and maintain a record of complaints filed against LSRPs and provide the public with information upon request.”
SEAT RESTRICTIONS: The Board is to consist of thirteen members in accordance with Section 3 of the Site Remediation Reform Act (SRRA). The Commissioner of the New Jersey Department of Environmental Protection (or his or her designee) serves as Chairperson of the Board. The Commissioner has designated the Assistant Commissioner of NJDEP’s Site Remediation Program to serve as Chairperson. The State Geologist also serves on the Board along with eleven public members, residents of the State, who are appointed by the Governor with the advice and consent of the Senate. State Mosquito Control Commission

Waterfowl Stamp Advisory Committee

PURPOSE: The committee is advisory and provides land acquisition recommendations to the Commissioner of DEP, through Fish and Wildlife. The Waterfowl Stamp Advisory Committee Oversees the Waterfowl Stamp program and recommends each year’s stamp design. This committee also has the responsibility for recommending habitat conservation and acquisition projects to be funded by stamp and print revenues.

Watershed Property Review Board

PURPOSE: The Watershed Property Review Board is an independent Board and is not a division of the New Jersey Department of Environmental Protection. The Board is authorized to exempt the conveyance of watershed property from the Act if it can be demonstrated that there is a compelling public need for the conveyance of the property, denial of the exemption would result in extraordinary hardship, or that the sale or development of the watershed property is otherwise consistent with the purposes of the Act, which are to protect water quality and encourage open space preservation.
SEAT RESTRICTIONS: The Board is comprised of the Commissioner of the NJDEP, the Commissioner of the Department of Community Affairs (DCA) and the President of the Board of Public Utilities (BPU). Wetlands Mitigation Council

PURPOSE: The “Freshwater Wetlands Protection Act” established a program for the systematic review of activities in and around freshwater wetland areas. The Act also creates the Wetlands Mitigation Council within the Wetlands Mitigation Bank to act as its governing body. The Council is responsible for the proper disbursement of funds from the Bank to finance mitigation projects. It shall have the power to purchase land as a means of providing areas for the restoration of degraded freshwater wetlands.
SEAT RESTRICTIONS: The membership shall include the following: the Commissioner of the Department of Environmental Protection who shall serve ex officio; and 6 members from the general public appointed by the Governor with the advice and consent of the Senate who shall be representatives of the following: 2 members recommended by environmental and conservation organizations; 2 members recommended by recognized building and development organizations; and 2 members recommended by institutions of higher education.

Wildlife Rehabilitators Advisory Committee

PURPOSE: The Wildlife Rehabilitators Advisory Committee provides assistance and advice to the Division of Fish and Wildlife on wildlife rehabilitation issues. Committee members discuss issues of concern and recommend actions to the Division, so as to improve the wildlife rehabilitation program and the care that is provided to New Jersey’s injured and orphaned wildlife.
SEAT RESTRICTIONS: The Committee is composed of nine members and includes two avian rehabilitators, three mammal rehabilitators, one veterinarian, one representative from the Endangered and Nongame Species Advisory Committee, one representative from the Fish and Game Council, and a representative from another state department (currently the NJ Department of Agriculture).
